Identify Whether the Matter Is State or Federal

Insurance-fraud allegations can be investigated under Florida law, federal law, or both, depending on the alleged conduct, communications, people involved, and agencies involved. A federal agency’s involvement does not by itself establish a federal charge. The complaint, indictment, subpoena, or other written notice identifies the actual allegation and the court or agency handling it.

Florida’s insurance-fraud statute addresses particular false, incomplete, or misleading statements made with the intent to injure, defraud, or deceive an insurer. The full wording and penalty provisions are available in Florida Statutes section 817.234. Whether a statute applies in a specific case turns on the evidence and elements, not a general description of a claim.

Preserve the Claim File and Related Records

Keep the policy, application, claim forms, photographs, estimates, medical or repair records, payment information, messages, and notices in their original form. If data is held by an insurer, repair facility, health-care provider, accountant, or another party, note where it is held and retain any copies already available. Do not alter, delete, backdate, or recreate records after learning of an inquiry.

A timeline should identify when a loss occurred, when it was reported, who prepared each document, what information was available at the time, and how payments were handled. This is more useful than broad labels because it connects each factual question to a source document.

Separate a Disputed Claim From an Intent Allegation

A disputed valuation, an incomplete record, or a disagreement about coverage is not automatically proof of an intentional false statement. A review may examine the wording of a claim, the materiality of information, the person who made a representation, and evidence relevant to knowledge or intent. Those are distinct factual questions.

Respond to Formal Requests by Their Terms

Read a subpoena, interview request, warrant, or agency notice carefully. Record the sender, deadline, scope, requested format, and delivery instructions. Retain a copy of every item produced and confirmation of delivery. If an item cannot be located, document the systems searched rather than substituting a recreated document.

Questions That Make a Review More Precise

For each statement connected to a claim, identify the author, audience, date, source documents, and the reason it was made. For each payment, identify the policy, claim number, payee, and supporting records. If an investigator describes a document as incomplete or misleading, compare that description with the complete file and the wording of the question asked. This structured approach avoids treating a disputed fact as a conclusion.

Records should be organized by source and date. A simple index can list policy records, claim materials, communications, and financial documents without changing the originals. It gives a reviewer a way to locate the record on which a factual statement rests.
